Appellant, Jacob Eguia, appeals from a judgment convicting him for capital murder for causing the death of Ruby Elaine Garcia and her unborn child during the same criminal transaction. See TEX. PEN. CODE ANN. §§ 19.02(b)(1), 19.03(a)(7)(A) (Vernon Supp.2008). Appellant was sentenced to life in prison, which was the only possible sentence since the State did not seek the death penalty.
