COCHRAN, J., delivered the opinion of the Court, in which PRICE, WOMACK, JOHNSON and HOLCOMB, JJ., joined.

During the early morning hours of September 1, 2003, the bodies of three employees were found inside a small office of the Outback Steakhouse in Texarkana. Each had been shot.
