In this appeal, we consider whether a non-patient's claim, pleaded as a negligence claim for injuries against a hospital, constitutes a "health care liability claim" pursuant to section 74.001(a)(13) of the Texas Civil Practice and Remedies Code, requiring the plaintiff to file an expert report pursuant to section 74.351(a) of the Texas Civil Practice and Remedies Code.
