[¶ 1.] Donald Jacobs worked for Dakota, Minnesota, & Eastern Railroad Corporation (DM & E). Jacobs was injured on the job when he fell on snow-covered ice. Jacobs suffered severe injuries to his elbow and shoulder as a result.
