OPINION

Justice FLAHERTY, for the Court.

On the evening of December 4, 2002, a group of friends gathered to celebrate the birthday of Tammy Kennedy at her apartment. However, the intended festivities soon took a tragic turn, and, before the night was over, three people at the party suffered gunshot wounds and one of them, nineteen-year-old Joel Jackson, was dead. The defendant, Kendall Whitaker, eventually was charged, tried, and convicted on multiple counts...
