Justice ROBINSON for the Court.

The defendant, Christopher J. Gaylor, appeals from a May 16, 2008 Superior Court order denying a motion whereby he sought credit for time served while awaiting trial. The defendant filed a timely notice of appeal.

This case came before the Supreme Court on February 3, 2009 pursuant to an order directing the parties to appear and show cause as to why the issues raised in this appeal should not be summarily decided...
