Chief Justice WILLIAMS (ret.), for the Court.

The defendant, Robert Dominick (defendant), filed the instant appeal after the jury rendered a verdict adjudging him guilty of assault and battery upon a person over the age of sixty in violation of G.L. 1956 § 11-5-10. On appeal the defendant submits several errors alleged to have occurred during the trial on the merits. This case came before the Supreme Court for oral argument on April 8, 2009...
