The defendant, Clyde Gillespie (defendant), appeals his convictions for second-degree murder and for failing to report a death with the intention of concealing a crime. He alleges that the trial justice erred in: (1) instructing the jury that premeditation is not an element of second-degree murder; (2) instructing the jury on second-degree murder where, as the defendant contends, such a charge was not supported...
