No. 27 MAP 2015

136 A.3d 493 (2016)

COMMONWEALTH of Pennsylvania, Appellant, v. Claude DESCARDES, Appellee.

Supreme Court of Pennsylvania.

Resubmitted January 20, 2016.

Decided March 29, 2016.

Attorney(s) appearing for the Case

David Richman, Esq. , Pepper Hamilton LLP, Philadelphia, for Pennsylvania Innocence Project and the Pennsylvania Association of Criminal Defense Lawyers, Amicus Curiae.

Bruce Richard Beemer, Esq. , Kelly M. Sekula, Esq. , Pennsylvania Office of Attorney General, for Commonwealth of Pennsylvania.

William J. Honig, Esq. , Norristown, for Claude Descardes.

SAYLOR, C.J., BAER, TODD, DONOHUE, DOUGHERTY, WECHT, JJ.

OPINION

In this discretionary appeal by the Commonwealth, we consider whether Appellee Claude Descardes was entitled to seek review of his ineffectiveness of counsel claim, based on counsel's failure to advise him of the collateral consequences of his guilty plea, via a petition for writ of coram nobis.
