The Commonwealth appeals from the order of the Court of Common Pleas of Allegheny County granting appellee's Post-Conviction Relief Act (PCRA)1 petition and vacating his sentence of death on the basis that appellee demonstrated, by a preponderance of the evidence, that he is mentally retarded.
