Mark C. Whymeyer (Whymeyer) petitions for review of the July 23, 2008 order of the State Registration Board for Professional Engineers, Land Surveyors and Geologists (Board) denying his appeal from a provisional denial of his application to sit for the fundamentals of engineering examination pursuant to Section 4.2(b)(1)(i) of the Engineer, Land, Surveyor and Geologist Registration Law (the Law).1
