ARIO v. UNDERWRITING MEMBERS OF LLOYD'S

No. 553 M.D. 2008

996 A.2d 588 (2010)

Joel S. ARIO, Insurance Commissioner of the Commonwealth of Pennsylvania, in his official capacity as Liquidator of Reliance Insurance Company, Plaintiff, v. UNDERWRITING MEMBERS OF LLOYD'S OF LONDON SYNDICATES 33, 205 AND 506, Defendants.

Commonwealth Court of Pennsylvania.

Publication Ordered June 16, 2010.

Attorney(s) appearing for the Case

Deborah F. Cohen, Philadelphia, for plaintiff.

Jonathan L. Swichar, Philadelphia, for defendants.

OPINION BY President Judge LEADBETTER.

In this action by the Liquidator for payment pursuant to a contract of reinsurance, the parties have filed cross-motions for summary judgment raising two issues: (1) whether the Liquidator's action is barred by the statute of limitations; and, if not, (2) whether late notice of the claim relieved the defendants, Lloyd's of London Syndicates 33 and 205 (Syndicates) of any obligation under the reinsurance contract.
