In 2010, defendant in this case pleaded guilty to two counts of first-degree sexual abuse. In 2014, defendant, who was incarcerated, filed a petition for appointment of counsel at state expense under ORS 138.694 (2013) to assist him in determining whether to request DNA testing under ORS 138.690 to 138.698.1
