Defendant appeals from a judgment of conviction for misdemeanor driving under the influence of intoxicants (DUII), ORS 813.010, arguing that the trial court erred in denying his motion to dismiss on speedy trial grounds under former ORS 135.747 (2011), repealed by Or. Laws 2013, ch. 431, § 1. On review for errors of law, State v. Johnson, 339 Or. 69, 82-87, 116 P.3d 879
