Defendant was convicted after a jury trial of two counts of first-degree sexual abuse, ORS 163.427, for his conduct involving a five-year-old girl. The state was required to prove that defendant touched or attempted to touch the child's sexual or other intimate parts "for the purpose of arousing or gratifying the sexual desire of" either party.
