Defendant appeals from a judgment of conviction for driving under the influence of intoxicants (DUII), ORS 813.010, reckless driving, ORS 811.140, and two counts of second-degree criminal mischief, ORS 164.354. He contends that the trial court erred in failing to dismiss the case for unreasonable delay under ORS 135.747, which requires that a defendant who is "charged with a crime" be "brought to trial within a reasonable period of time."
