Plaintiff brought a civil action against the State of Oregon for false imprisonment, asserting in his complaint that a judge unlawfully imprisoned him by declining to stay his sentence pending appeal in a criminal case. The state filed a motion to dismiss plaintiff's claim on the ground that it was time barred by a two-year statute of limitations.
