Defendant appeals from his conviction for driving under the influence of intoxicants (DUII), ORS 813.010. The charged conduct occurred on April 22, 2002, but defendant was not brought to trial until March 11, 2009. Defendant filed a motion for dismissal of the charging instrument on the ground that he was not afforded a speedy trial. ORS 135.747.
