This case is before this court for the third time on automatic and direct review of a judgment that imposed a sentence of death for aggravated murder.1 This court has previously affirmed defendant's aggravated murder convictions, but twice has vacated his sentence of death and remanded for further penalty-phase proceedings, as we discuss in greater detail below.
