Defendant was convicted by a jury of four counts of assault, including assault in the third degree (Count 2), ORS 163.165(1)(e),1 and pleaded guilty to four counts of tampering with a witness. The court imposed a total term of incarceration of 96 months of imprisonment with three years of post-prison supervision, including a presumptive sentence of 14 months of imprisonment on Count 2.
