¶ 1 Appellant, Roderick L. Smith, was convicted by a jury in Oklahoma County District Court, Case No. CF-1993-3968, of five counts of First Degree Murder, 21 O.S.1991, § 701.7(A) He was originally sentenced to death on all five counts.
