I. Introduction

{¶ 1} This is a consolidated appeal from two separate judgments of the Sandusky County Court of Common Pleas, granting summary judgment in favor of defendants-appellees, Sandusky Township Sewer District ("Sandusky Township") and Crestline Paving and Excavating, Inc. ("Crestline"). For the reasons that follow, we affirm, in part, and reverse, in part.
