MOORE, Judge.

{¶1} Defendant, Marcus Gary, appeals from the judgment of the Wayne County Court of Common Pleas. This Court affirms.

{¶2} On October 3, 2011, the Wayne County Grand Jury indicted Mr. Gary on one count of rape in violation of R.C. 2907.02(A)(2) and one count of sexual battery in violation of R.C. 2907.03(A)(1). At his arraignment, Mr. Gary pleaded not guilty...
