OPINION

VUKOVICH, J.

{¶1} Appellant State of Ohio appeals the decision of the Mahoning County Juvenile Court that dismissed the complaint against alleged delinquent child-appellee D.R. The complaint asserted that D.R. was delinquent because he committed two counts of statutory rape. The basis for dismissing the complaint was the Ohio Supreme Court's decision in In re D.B., 129 Ohio St.3d 104
