{¶1} On June 17, 2009, the Stark County Grand Jury indicted appellant, James Mammone, III, on three counts of aggravated murder in violation of R.C. 2903.01 with death penalty specifications in violation of R.C. 2929.04(A)(5), (7), and (9).
