{¶1} Defendant-appellant, the Cuyahoga County Board of Mental Retardation ("the Board"), appeals the trial court's judgment denying its motion for judgment on the pleadings as to Count 2 of the second amended complaint of plaintiff-appellee, James Young, Administrator of the Estate of Kimberly Young, Deceased.
