Aggarwal, filed this action against defendant, Department of Transportation (ODOT), alleging ODOT's negligence proximately caused two basement apartments to become flooded with storm water runoff. Plaintiff claimed ODOT was negligent in failing to maintain "the main curb drain" which became clogged.
