MEMORANDUM DECISION

{¶1} Plaintiff, Gene Durbin, filed this action against defendant, Ohio Department of Transportation (ODOT), contending that his vehicle was damaged as a proximate result of negligence on the part of ODOT in maintaining a hazardous condition on State Route 18. In his complaint, plaintiff described the particular damage event noting that he "ran into a pothole in the road, that was 2 feet wide by 6 feet long and 6 to 8 inches...
