{¶ 1} On October 7, 2009, around 11:00 p.m., Officer Gustwiller and Officer Dedrick were on duty, patrolling in an area designated by police as the Phoenix Project. Officers were assigned to patrol the Phoenix Project to address criminal activity in the eight-block area surrounding Good Samaritan Hospital. Gustwiller had been assigned to this area for over a year. Dedrick had been assigned to the area for about two and one-half years...
