{¶ 1} This matter is before the Court on the Notice of Appeal of David C. Sparks, filed July 30, 2010. On July 1, 2010, Sparks received a citation for operating a motor vehicle while under the influence of alcohol ("OVI"), and OVI with a prior OVI conviction within 20 years.
