{¶ 1} On April 27, 2011, defendant filed a motion for summary judgment pursuant to Civ.R. 56(B). On May 18, 2011, plaintiff filed a response and cross-motion for summary judgment pursuant to Civ.R. 56(A). On May 23, 2011, defendant filed a response.
