OPINION

GRADY, P.J.

{¶ 1} Defendant, Thomas Calvert, pled guilty to one count of burglary, R.C. 2911.12(A)(3), a felony of the third degree. As part of the plea agreement, the parties stipulated that Defendant's sentence would not exceed three years. The trial court sentenced Defendant to a three year prison term.
