CONNOR, J.

{¶ 1} Defendant-appellant, Commonwealth Land Title Insurance Company ("appellant" or "Commonwealth"), appeals the judgment of the Franklin County Court of Common Pleas granting summary judgment in favor of plaintiff-appellee, Guernsey Bank ("appellee" or "Guernsey Bank"), and denying appellant's cross-motion for summary judgment. For the following reasons, we affirm in part and reverse in part.
