{¶ 1} Plaintiff, Joe Tomba, filed this action against defendant, Department of Transportation (ODOT), contending that ODOT should bear responsibility for paint damage to his 1996 Dodge Ram 1500. Plaintiff recalled he was traveling on State Route 84 in Lake County on September 30, 2010 when his paint damage incident occurred.
