OPINION

GRADY, P.J.:

{¶1} On or about June 28, 2009, Defendant, Kristopher Nealeigh, Amber Fraley, and Mark Toney were all using heroin. Defendant overdosed, requiring paramedics from the Urbana Fire Department and Champaign County Sheriff's deputies to respond to a call for emergency medical assistance.
