{¶ 1} Plaintiff-appellant Buckeye Retirement Co., LLC, Ltd. appeals from a summary judgment rendered in favor of defendant-appellee John R. Busch. Buckeye contends that the trial court erred in rendering summary judgment in Busch's favor on the basis of res judicata, because Busch was not a party to a prior action involving Buckeye, and Busch is not in privity with a party to the prior action.
