FRENCH, J.

{¶ 1} Defendant-appellant, John Caldwell Timmons, appeals the judgment of the Franklin County Court of Common Pleas, Probate Division, which granted summary judgment in favor of plaintiff-appellee, Rak-Ree Enterprises, Inc ("Rak-Ree"). For the following reasons, we affirm.
