{¶ 1} This matter is before the Court on the Notice of Appeal of John Maguire, filed July 16, 2010. On March 8, 2007, Maguire filed a complaint against National City Bank ("NCB"), alleging that the bank had breached a contract for the purchase of real property located at 2243 Titus Avenue.
