{¶ 1} This matter is before the Court on the State's Notice of Appeal, filed March 11, 2010. On December 4, 2009, Kevin L. Jones was indicted on one count of trafficking in marijuana, in violation of R.C. 2925.03(A)(2), a felony of the fifth degree. Jones pled not guilty.
