{¶ 1} This matter is before the court on the notice of appeal of Robert H. Perkins, filed October 21, 2009. On October 22, 2008, Perkins was indicted on one count of aggravated assault, in violation of R.C. 2903.12(A)(2), a felony of the fourth degree. Perkins pleaded not guilty, and he filed a motion to suppress, which was granted in part after a hearing. On April 17, 2009, the state dismissed the aggravated-assault charge...
