{¶ 1} This matter is before the Court on the Notice of Appeal of Todd Eaton, filed October 1, 2009. Eaton appeals his convictions and sentences, following a jury trial, on one count of rape, in violation of R.C. 2907.02(A)(1)(b)(B), a felony of the first degree, and one count of gross sexual imposition, in violation of R.C. 2907.05(A)(4)(C)(2), a felony of the second degree.
