{¶ 1} Plaintiff, Marion Pytlak, filed this action against defendant, Department of Transportation (ODOT), alleging his building, located adjacent to State Route 149 in Neffs, Ohio, received water damage from passing traffic after ODOT installed a drainage grate approximately fifty inches from the front entrance to the building.
