{¶ 1} Appellants Ned Peppers, Inc., Mark Schaefer, and Mark Luttrell appeal from a summary judgment rendered against them on their third-party complaint filed against the City of Dayton and Colony Insurance Company. Appellants contend that the trial court erred in rendering summary judgment against them, because they established genuine issues of material fact sufficient to withstand summary judgment.
