{¶ 1} This matter is before the Court on the Notice of Appeal of Olan Ray Brinegar, filed February 27, 2009. On December 13, 2007, Brinegar was indicted on one charge of endangering children (serious physical harm), in violation of R.C. 2919.22(B)(1), a felony of the second degree.
