MEMORANDUM DECISION

On August 4, 2009, at approximately 10:00 a.m., plaintiff, Donald J. Like, Jr., was traveling north on Interstate 75 in Dayton "between exits of 55 & 57 B" when his 2006 Buick Terraza van struck "a very large pothole" causing tire and rim damage to his vehicle. Plaintiff asserted that the damage to his vehicle was proximately caused by negligence on the part of defendant, Department of Transportation (ODOT), in failing to maintain the roadway...
