MEMORANDUM DECISION

{¶ 1} On June 24, 2009 and June 25, 2009, employees of defendant, Department of Transportation (ODOT), excavated and replaced a culvert pipe spanning U.S. Route 36 at milepost 21.92 in Knox County. According to ODOT work records in reference to the culvert betterment, thirteen tons of "#9 Gravel" and three tons of "Asphalt Grindings" were used to fill in the excavation around the replaced culvert on June 24, 2009.
