MEMORANDUM DECISION

{¶ 1} On December 9, 2008, at approximately 11:00 p.m., plaintiff, Sherri Chenoweth, was traveling south on Interstate 75 between mile markers 53 and 54 in the proximity of a construction zone, when her 2003 Nissan Sentra struck a large pothole causing rim damage to the vehicle. Plaintiff specifically located the pothole "at approximately mile marker 53.8 in the left lane" of Interstate 75.
