FINDINGS OF FACT

{¶ 1} 1) On April 24, 2009, at approximately 1:35 p.m., plaintiff, Timothy L. Miner, Sr., was traveling north on Interstate 77 in Tuscarawas County, when his 1988 Ford truck struck a pothole causing substantial damage to the vehicle.
