{¶ 1} On July 1, 2009, plaintiff, Jan Van Mossevelde, filed a complaint against defendant, Department of Transportation. Plaintiff alleges on April 5, 2009, he struck a pothole while turning from 12th Street onto Clay Street in Cincinnati, Ohio.
