{¶1} Appellant, Russell J. Biondo, appeals from the judgment entry overruling his "Motion to Vacate and Dismiss Court Imposed Fines and Court Costs." At issue is whether our recent judgment in State v. Biondo, 2008-P-0028, 2008-Ohio-6560, in which this court vacated Mr. Biondo's post release control due to the trial court's original failure to properly notify him that he would be subject to such sanctions...
